What's covered under the Article:

  1. Apple is accused by developers of violating a 2021 court order that allowed cheaper purchases outside the App Store.

  2. Developers allege Apple charged inflated commissions and blocked apps, costing them millions in lost revenue.

  3. The case stems from a judge's ruling in the Epic Games lawsuit, leading to a broader class action involving 100,000 developers.

Apple Inc. is once again in the legal spotlight as a proposed class action lawsuit filed by app developer Pure Sweat Basketball claims the tech giant violated a U.S. federal court order by continuing to impose inflated App Store commissions even after a 2021 injunction that should have stopped such practices. The developers allege that Apple’s actions have caused hundreds of millions or even billions of dollars in damages.

Origins of the Dispute: The Epic Games Case

The roots of this legal confrontation lie in the Epic Games v. Apple case. In 2021, a U.S. District Court ruled in favour of app developers to allow alternate payment methods outside Apple’s App Store. This decision aimed to limit Apple’s monopoly over in-app purchases and reduce the 30% commission fee developers had to pay. However, developers now argue that Apple never truly complied with that injunction.

Allegations Made by Pure Sweat Basketball

In a recent filing in Oakland, California, Pure Sweat Basketball has alleged that:

  • Apple defied the injunction by imposing a new 27% commission on purchases made outside the App Store.

  • It blocked app listings that contained links redirecting users to external purchase platforms.

  • Apple continued operating as if no injunction was ever passed, retaining its billion-dollar revenue from in-app transactions.

The lawsuit could include up to 100,000 developers, making it a potentially massive legal challenge for Apple.

Apple’s Legal Defence and Appeal

Apple has denied any wrongdoing, stating that the 27% fee complies with the court's order. It filed a notice of appeal challenging the recent ruling by Judge Yvonne Gonzalez Rogers, who said the company willfully violated her injunction.

The judge also referred Apple and a top executive to federal prosecutors for potential criminal contempt charges. This adds a serious dimension to what was previously viewed as a corporate legal dispute.

Developer's Stand and Industry Response

Steve Berman, lead attorney for Pure Sweat, said the lawsuit was aimed at obtaining justice for app developers who were unfairly charged. He emphasised the financial burden placed on developers who were supposed to benefit from greater freedom in payment options after the 2021 ruling.

The complaint seeks to recover the inflated commissions paid to Apple and disgorge wrongful profits the tech company earned during the period of alleged non-compliance.

Apple’s App Store Practices Under Scrutiny

This is not the first time Apple’s App Store commission policies have drawn fire. Governments and developers worldwide have questioned Apple’s dominance in the app marketplace. In fact, Hagens Berman, the same law firm representing Pure Sweat, is also representing consumers in another lawsuit that accuses Apple of illegally monopolising the smartphone market.

Apple's tight control over app distribution, payment methods, and policies has been a long-standing point of contention. The company's business model heavily relies on its App Store, making any disruption in this area critical to its revenue and public image.

What Could Be at Stake

Should the plaintiffs succeed, Apple may be required to:

  • Return hundreds of millions of dollars in commissions to affected developers.

  • Revise its App Store policies to provide genuinely fair options for alternate payment methods.

  • Face criminal investigations into whether it deliberately misled the court and the developers.

Looking Ahead

This lawsuit could serve as a landmark moment in the ongoing debate over the power of big tech companies. If Apple is found guilty of contempt or non-compliance, it could encourage regulators globally to enforce similar rulings in their jurisdictions. Furthermore, the outcome might redefine how digital marketplaces operate in relation to antitrust and fair competition laws.

While Apple continues to battle these allegations, the broader community of app developers and legal experts will be watching closely. The case could ultimately reshape the future of app development economics and developer-platform relationships.
