Bajaj Electricals Faces GST Demand Reaffirmed by GST Appeal Order, Evaluates Legal Options

On April 22, 2025, Bajaj Electricals Limited, a prominent player in the electrical and home appliances market, received an adverse appeal order from the Joint Commissioner of Commercial Taxes (Appeals-1), Bengaluru, in relation to an ongoing Goods and Services Tax (GST) dispute. This order, issued under Section 107 of the SGST Act, 2017 and the CGST Act, 2017, reaffirmed a GST demand that had been previously raised. The demand, totaling Rs. 429.44 lakh, includes Rs. 194.84 lakh as tax demand, Rs. 215.12 lakh in interest, and a general penalty of Rs. 19.48 lakh.

The company had been under scrutiny since August 2024 when it was notified of a demand for alleged excess input tax credit (ITC) claims, as well as short payments of GST for the fiscal year 2019–20. The order also follows an earlier communication, which indicated that Bajaj Electricals had failed to comply with certain provisions under the Karnataka Goods and Services Tax Act, 2017.

While the company has been provided the appeal order, there are concerns over the fact that the order was issued without a sufficient opportunity for Bajaj Electricals to present its case. This has raised questions about the procedural fairness of the proceedings. Consequently, Bajaj Electricals is currently evaluating its next steps, including the possibility of filing an appeal with the GST Tribunal or a writ petition before the Hon’ble High Court.

Despite the legal developments, Bajaj Electricals has assured its stakeholders that the dispute will have no adverse effect on the company’s financial operations or its regular activities. The company remains focused on its core operations and business growth, despite the ongoing legal proceedings.
