Key Points:
Prosecution Sanction: CBI has received approval to prosecute Delhi CM Arvind Kejriwal and AAP MLA Durgesh Pathak in a corruption case.
Judicial Custody: Kejriwal's judicial custody in the case is set to end on August 27.
Supreme Court Hearing: SC has deferred Kejriwal’s bail plea hearing to September 5.
The Central Bureau of Investigation (CBI) has received the necessary sanctions to prosecute Delhi Chief Minister Arvind Kejriwal and AAP MLA Durgesh Pathak in connection with the ongoing corruption investigation related to the Delhi excise policy case. This development was presented before Special Judge Kaveri Baweja in a Delhi court on Friday.
Legal Proceedings and Upcoming Hearings
The CBI informed the court that it had obtained the required sanction to move forward with the prosecution of both Kejriwal and Pathak. Kejriwal's judicial custody in the case is set to expire on August 27, and the matter has been scheduled for further hearing on that date.
Previously, on August 12, the court granted the CBI a 15-day period to secure the necessary sanctions for prosecuting the Delhi Chief Minister and the AAP MLA.
Supreme Court Developments
In another significant development, the Supreme Court on Friday postponed the hearing of Arvind Kejriwal’s pleas for bail and his challenge to the CBI's arrest until September 5. The SC bench, comprising Justices Surya Kant and Ujjal Bhuyan, granted the CBI time to file its counter affidavit and allowed Kejriwal two days to file a rejoinder.
During the hearing, Abhishek Singhvi, counsel for Kejriwal, pointed out that the CBI had only filed a counter affidavit in one of the pleas, which was served late on Thursday evening. Additional Solicitor General (ASG) SV Raju assured the court that the counter affidavit in the second plea would be filed within a week.
The apex court had previously refused to grant interim bail to Kejriwal on August 14, while seeking a response from the CBI on his plea challenging his arrest. Kejriwal’s arrest on June 26 by the CBI has been a point of contention, with the Delhi High Court upholding it as legal on August 5. The High Court also noted that there was no malice in the CBI's actions, stating that the agency was able to demonstrate the potential influence Kejriwal could exert on witnesses.
Implications of the Case
The ongoing investigation into the Delhi excise policy has significant political implications, particularly for the Aam Aadmi Party (AAP) and its leadership. With the CBI securing the sanction to prosecute Kejriwal and Pathak, the case is expected to proceed with heightened scrutiny from both the public and political spheres.
As the case continues to unfold, the upcoming hearings in both the Delhi court and the Supreme Court will be critical in determining the legal trajectory for Kejriwal and his associates. The developments on August 27 and September 5 will likely provide further clarity on the charges and potential outcomes for the accused.
Conclusion
The CBI's recent success in obtaining prosecution sanctions against Delhi Chief Minister Arvind Kejriwal marks a pivotal moment in the ongoing excise policy corruption case. With judicial proceedings set to continue, the case remains a focal point of legal and political attention in Delhi.
