India Patent Filings Soar, Led by Educational Institutes

A recent report reveals a remarkable surge in patent filings in India, particularly by educational institutions like universities. The surge, attributed to extensive awareness campaigns on intellectual property, has seen a significant increase in filings, with educational institutes accounting for a substantial share. Despite India's rising share in global patent grants, challenges remain, as foreign entities continue to hold the majority of patents in force.

India's patent landscape is witnessing a transformative shift, as highlighted by a recent report showcasing a significant surge in patent filings, notably driven by educational institutions such as universities. The report, based on the patent office's 2022-23 annual report, reveals that educational institutes' share of patent filings has more than doubled, rising from 11% in FY21-22 to 23% in FY23. This surge is attributed to an extensive awareness mission that has educated 1.9 million students and educators across 7,377 educational institutions about intellectual property, thereby encouraging increased patent applications.

In FY23 alone, educational institutes filed a staggering 19,430 patents, showcasing a remarkable rise from the previous fiscal year's 7,501 filings. This surge in Indian patent filings reflects a broader trend, with a 63% increase observed since the onset of the COVID-19 pandemic. In FY23, over 82,811 patents were filed compared to 50,659 in FY19. While Indians filed more patents domestically than foreigners for the second consecutive year, it's worth noting that most patents in force are held by foreign entities.

The report also sheds light on the patent landscape, revealing that computer science dominates with a quarter of applications, followed by mechanical engineering at 18%, and chemical applications, including pharmaceuticals, at 14%. Despite India's increased share in global patent grants, it holds the fourth position among the world's largest economies, with China, the US, and Japan collectively representing over 70% of global patents. Notably, China's patent share has surged from 17.8% to 43.8%, raising questions about the quality of its patents.
