Supreme Court Issues Notice on Mullaperiyar Dam Replacement Plea

The Supreme Court of India has issued notices to the Centre, Kerala, Tamil Nadu, and the National Disaster Management Authority (NDMA) in response to a public interest litigation (PIL) seeking the construction of a new dam to replace the aging Mullaperiyar dam.

The Mullaperiyar dam, situated in Kerala but operated by Tamil Nadu, has long been a subject of dispute due to safety concerns, given its age and structural vulnerabilities. The PIL emphasizes the potential risk to millions of residents in downstream areas and urges immediate action to construct a modern, safer dam.

By including the Centre and NDMA as respondents, the PIL also seeks to hold central authorities accountable for ensuring national disaster preparedness and regulatory compliance in dam safety. The Supreme Court’s notice signifies the judicial system’s intent to closely examine the feasibility, safety, and legal aspects of replacing the dam.

The authorities are now required to respond to the plea within the time frame stipulated by the Court, which will determine the next steps, including possible inspections, expert assessments, and timelines for the proposed dam construction.

Experts note that this case highlights the critical balance between infrastructure safety and inter-state water-sharing disputes, as Tamil Nadu and Kerala have historically disagreed over operational control and water release from Mullaperiyar.

The Supreme Court’s intervention could pave the way for a long-term solution, ensuring the safety of downstream populations while addressing inter-state concerns. The case is now under judicial scrutiny, and further hearings will focus on technical, environmental, and administrative considerations related to building a new dam.
