The Supreme Court of India on Friday firmly upheld the Election Commission of India’s (ECI) September 1 deadline for filing claims and objections under the Special Summary Revision (SIR) of electoral rolls in Bihar. The ruling comes after political parties sought an extension, citing the need for additional time to ensure voter inclusivity. However, the Court maintained that the process had already covered the majority of eligible voters and that extending the timeline would lead to procedural complications.
During the hearing, the ECI clarified that although the September 1 deadline had been fixed for orderly conduct, valid claims and objections submitted even after the cut-off date would not be ignored. The Commission assured that such applications would be carefully reviewed up to the last date for filing of nominations, ensuring that no eligible voter is left disenfranchised.
The Court recorded this assurance but stressed that allowing a blanket extension would result in an “endless process”, thereby jeopardising the electoral schedule mandated under the rules. The Bench emphasized that adherence to deadlines is crucial to preserve the integrity and efficiency of the electoral system, particularly in a state like Bihar, which has a large and complex voter base.
The ECI further informed the Court that in Bihar, out of 2.74 crore voters included in the draft electoral rolls, 99.5% had already submitted eligibility documents. This indicated a very high level of compliance and participation from citizens. For the small fraction of voters whose documentation remained incomplete, the Commission stated that notices would be issued within seven days, giving them another opportunity to correct their records.
Political parties were directed to actively cooperate with the ECI in completing the voter verification and correction process. The Court noted that their role was crucial in ensuring that the democratic process is both inclusive and efficient. The Bench dismissed the argument that denying an extension would harm electoral participation, highlighting that adequate mechanisms had already been established to include late claims.
The ruling effectively ensures that the finalisation of electoral rolls will remain on schedule, a step necessary for smooth elections in Bihar. By refusing to extend the deadline, the Supreme Court has reinforced the principle of strict timelines in election-related matters, a consistent position it has taken in past rulings to prevent delays in the democratic process.
