On Monday, Donald Trump announced the delay of the TikTok ban in the United States, extending it by 75 days. This decision comes after significant concerns about the potential national security risks posed by the app, which is used by 170 million Americans. The executive order, signed by Trump, directs the U.S. Attorney General to halt enforcement of the Foreign Adversary Controlled Applications Act during this period. This Act, passed with bipartisan support in Congress and signed by President Joe Biden in April 2024, required a ban on TikTok in the U.S. starting January 19, 2025, unless it was sold to an American company or one of its allies.
However, Trump’s executive order allows for an additional 75 days to ensure that a resolution is reached that protects national security while ensuring that a communication platform widely used by millions of Americans is not abruptly shut down. In his order, Trump emphasized his unique constitutional responsibility to safeguard national security and conduct foreign policy. During the 75-day period, the Department of Justice will not enforce the Act or impose penalties on any entities for noncompliance, including actions related to distributing or maintaining TikTok.
“I am instructing the Attorney General not to take any action to enforce the Act for a period of 75 days from today,” said Trump in the order, underlining the administration’s commitment to ensuring that national security is preserved without harming Americans’ access to TikTok.
In his executive order, Trump also pointed out that he will be consulting with his advisors, including heads of relevant departments, to evaluate the national security concerns TikTok might pose. The U.S. government will also review sensitive intelligence to assess whether the company has taken adequate measures to address these security concerns.
This delay comes after TikTok services were temporarily interrupted on January 18, only to resume a day later once the executive order was signed. This brief outage highlighted the urgency of resolving the issue quickly, especially considering the large user base in the U.S., where TikTok has become a platform for entertainment, communication, and business for millions of Americans.
In light of these developments, the next few months will be critical in determining whether the TikTok ban will eventually go into effect or if mitigation measures taken by the company will be deemed sufficient to protect national security while maintaining its operations in the U.S.
