The High Court has taken suo motu cognizance of the case, meaning it has initiated action on its own accord without a formal complaint. The investigation into the case has been described as thorough, with authorities pledging that “there will be no mistake anywhere,” according to the court.

The court inquired if the case was registered under the Protection of Children from Sexual Offences (POCSO) Act. Advocate General Biren Saraf confirmed that it was, and a woman officer was present during the registration. The court also questioned whether any action had been taken against the school authorities, noting that the POCSO Act includes provisions to hold responsible parties accountable if they fail to report such crimes.

A division bench consisting of Justice Revati Mohite Dere and Justice Prithviraj Chavan is overseeing the case. They have directed the Special Investigation Team (SIT) to submit a comprehensive report on the matter.

Union Minister and BJP MP from North Mumbai, Piyush Goyal, has publicly condemned the assault and called for stringent action against the perpetrators. He stated, “The accused should be severely punished and strict action should be taken at the earliest.” Goyal emphasized the need for punishment that would deter similar crimes and expressed confidence that the Chief Minister and Deputy Chief Ministers are addressing the issue. He also urged for the case to be expedited through a Fast Track Court.

The assault has led to massive public protests in Badlapur. On August 17, an attendant from the school was arrested in connection with the abuse, fueling local anger. Protests escalated, resulting in significant disruptions to railway services. On August 21, demonstrators blocked railway tracks at Badlapur station, causing the diversion of 12 mail express trains and partial cancellations of 30 local trains. The police responded with lathi-charges to disperse the crowds, which led to several arrests and FIRs. The situation has since been brought under control, but the disruption highlighted the intensity of public sentiment regarding the case.

Recommendations for Future Prevention

In response to the delays and the gravity of the situation, the Maharashtra State Commission for Protection of Child Rights (MSCPCR) has proposed the establishment of special branches or “mini-police stations” dedicated to women and children across the state. Chairperson Susieben Shah announced this recommendation during a press conference in Mumbai, emphasizing the need for improved mechanisms to handle such cases promptly.
