Report Reveals 151 MPs and MLAs with Criminal Charges Against Women, West Bengal Leads

On August 21, 2024, a report by the Association for Democratic Reforms (ADR) highlighted a troubling trend in Indian politics. The study, which analyzed 4,693 out of 4,809 affidavits submitted by sitting MPs and MLAs to the Election Commission of India for elections held between 2019 and 2024, found that at least 151 lawmakers have declared cases related to crimes against women. This significant finding comes amidst growing concerns about sexual violence across the country.

West Bengal emerged as the state with the highest number of lawmakers facing such charges, with 25 sitting MPs and MLAs involved. Following West Bengal, Andhra Pradesh reported 21 cases, and Odisha had 17. This data highlights a regional disparity in the prevalence of such cases, reflecting broader issues of accountability and legal scrutiny within the political landscape.

The ADR report specifically noted that 16 MPs and MLAs have declared cases related to rape under Indian Penal Code (IPC) section 376, which stipulates a minimum sentence of 10 years and can extend to life imprisonment. Of these, 2 are MPs and 14 are MLAs. The charges include instances of repeated offenses against the same victim, emphasizing the severity and recurrence of these crimes.

In terms of political party representation, the Bharatiya Janata Party (BJP) has the highest number of lawmakers with declared criminal cases against women, totaling 54 MPs and MLAs. The Congress follows with 23, and the Telugu Desam Party (TDP) has 17. Both BJP and Congress have 5 sitting lawmakers each facing rape charges.

In light of these findings, the ADR has issued strong recommendations for reform. The organization has urged political parties to avoid nominating candidates with criminal backgrounds, particularly those facing charges related to sexual violence. Furthermore, the ADR called for the fast-tracking of court cases involving MPs and MLAs to ensure swift justice. The report also emphasized the need for thorough and professional investigations by law enforcement agencies.

The ADR’s recommendations stress the importance of voters making informed choices and avoiding candidates with serious criminal charges, to promote greater accountability and integrity within the political system.
